PAIA Manual
This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000, and explains how to request access to records held by Mwalimu Resources (Pty) Ltd.

2. The PAIA Guide
The Information Regulator has compiled a guide, in terms of section 10 of PAIA, containing information on how to exercise rights under the Act. It is available from the Information Regulator.

3. Records available in terms of other legislation
Records are held and made available in accordance with, among others, the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Tax Administration Act 28 of 2011, the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Mine Health and Safety Act 29 of 1996, the Mineral and Petroleum Resources Development Act 28 of 2002, the National Water Act 36 of 1998, the National Environmental Management Act 107 of 1998 and the Protection of Personal Information Act 4 of 2013.
4. Records available without a formal request
The following records are freely available on this website and do not require a PAIA request: company overview information, descriptions of our operations, commodities and logistics capability, leadership profiles, contact details and these legal notices.
5. Categories of records held
Records are held in the following broad categories. Listing a category does not mean that a record in it will automatically be released; each request is assessed against the grounds for refusal in PAIA.
- Statutory and corporate records, including the memorandum of incorporation, registers and minutes.
- Financial records, including annual financial statements, tax and VAT records.
- Mineral rights and regulatory records, including mining and prospecting rights, water use licences and environmental authorisations.
- Technical and geological records, including borehole data, geological models and competent person's reports.
- Operational records, including production, haulage and quality records.
- Commercial records, including customer, supplier and offtake agreements and purchase orders.
- Employee and human resources records.
- Health, safety and environmental records.
- Insurance, asset and fleet records.
- Information technology and marketing records.
6. How to make a request
A requester must complete the prescribed form and submit it to the Information Officer at the address or email above.
- Use Form 2 of the PAIA Regulations, the prescribed request form for access to a record of a private body.
- Provide sufficient particulars to enable us to identify the record and the requester, and to identify the form of access required.
- Identify the right you are seeking to exercise or protect, and explain why the record is required to exercise or protect that right.
- If the request is made on behalf of another person, submit proof of the authority to act.
- Pay the prescribed request fee, where one is payable, before the request is processed.
We will respond within 30 days of receipt, and that period may be extended by a further 30 days in the circumstances contemplated in section 57 of PAIA. If access is refused, we will give reasons and inform you of your remedies.
7. Fees
Fees are those prescribed in the PAIA Regulations. A request fee may be payable before a request is processed, and an access fee may be payable for search, reproduction and delivery time before a record is released. A deposit may be required where preparation is expected to exceed six hours.
8. Grounds for refusal
Access may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including the mandatory protection of the privacy of a third party who is a natural person, the commercial information of a third party or of the company, records subject to legal privilege, confidential information supplied by a third party, and records the disclosure of which could reasonably be expected to endanger the safety of a person or property.
9. Remedies
A requester who is dissatisfied with a decision may lodge a complaint with the Information Regulator in terms of section 77A of PAIA, or apply to a court in terms of section 78 of PAIA.
